Personal data are processed in accordance with the law, including the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR").

Purposes and basis of personal data processing

Cooperation with the Agency

If you are a potential client or client of the Agency (individuals), your personal data is processed in connection with activities aimed at concluding a contract, for example, to determine the scope of the order and prepare a quote. If a contract is concluded under which the Agency will provide services to you, your personal data will be processed for the purpose of fulfilling that contract.

Your personal data may be processed on the basis and for the purpose of:

  • in connection with the activities undertaken by the Agency before concluding the contract aimed at its conclusion (determining the scope of the order in order to present an offer) – the legal basis for processing is the provision of Article 6 paragraph 1 letter b of the GDPR,
  • in order to properly execute the concluded contract – the legal basis for processing is the provision of Article 6 paragraph 1 letter b of the GDPR,
  • in order to comply with our legal obligations, e.g. those related to accounting – the legal basis for processing is Article 6(1)(c) of the GDPR,
  • pursuant to Article 6(1)(f) of the GDPR – if processing is necessary for the purposes of the legitimate interests pursued by the controller; such legitimate interests may be, for example, the pursuit and defence of potential claims by the Agency or the marketing of its own services.

If you are representatives or employees of the Agency's Clients, your personal data, in particular your name, surname, telephone number, e-mail address and position, may be processed for the purpose of concluding or implementing a contract concluded with the entity that is the Agency's Client.

Your personal data may then be processed pursuant to Article 6(1)(f) of the GDPR – processing is necessary for the purposes of the legitimate interests pursued by the Controller. The Controller's legitimate interests may include the Agency submitting an offer or the proper performance of a contract between the Agency and the Client, as well as the pursuit and defense of potential claims.

Use of the website

We may process data of people using the website https://adagri.com/ as well as information collected via cookies or other similar technologies:

  • for technical and administrative purposes and for the purposes of ensuring the security of the IT system and its management – ​​the legal basis for processing is our legitimate interest in ensuring security, removing possible failures and errors and managing the website (Article 6, paragraph 1, letter f of the GDPR),
  • in order to establish and pursue claims or defend against claims – the legal basis for processing is our legitimate interest in protecting our rights and the possibility of establishing, pursuing claims or defending against them (Article 6, paragraph 1, letter f of the GDPR),
  • for marketing and statistical purposes – the legal basis for processing is the consent given by the user of our website (Article 6, paragraph 1, letter a of the GDPR).

If you contact us via the form available on our website, we will process the personal data provided therein in order to respond, or possibly to protect our rights and the ability to establish, pursue or defend against claims (in both cases, the legal basis will be our legitimate interest – Article 6, paragraph 1, letter f of the GDPR).

Social media

We process the personal data of users who visit our social media profiles (LinkedIn). We process this data solely for the purpose of maintaining the profile, providing information about our activities, promoting our business, and communicating with users through available functionalities (comments, messages). The legal basis for processing is our legitimate interest in promoting our brand and services, building and maintaining a community associated with us, and for communication purposes (Article 6, paragraph 1, letter f of the GDPR).

Application form (recruitment)

We will process personal data provided in the application form used to recruit for positions at the Agency, including: first name, last name, contact details (e.g., email, phone number, address), information regarding education and professional experience, as well as image (if a photo is included in the application documents). We may also process information regarding the candidate's knowledge and skills (e.g., information about language skills).

We process candidates' personal data for the following purposes:

  • conducting recruitment for the position indicated in the advertisement, for which you send us your recruitment application,
  • conducting future recruitment for various positions, if you give your separate consent.

We process candidates’ personal data based on various legal bases, depending on the nature of employment in a given position.

In the case of cooperation (b2b), we process personal data based on the candidate's consent (i.e. pursuant to Article 6 paragraph 1 letter a of the GDPR), and if you consent to the processing of personal data for future recruitment purposes, we will also process them based on your consent (i.e. pursuant to Article 6 paragraph 1 letter a of the GDPR).

In the case of employment under an employment contract, we process the candidate's personal data, including first name, last name, date of birth, contact details, education, professional qualifications, and professional experience, to comply with our legal obligation (i.e., pursuant to Article 6(1)(c) of the GDPR). If you provide additional information about yourself in your recruitment application (e.g., image, interests), we process such data based on your consent (i.e., pursuant to Article 6(1)(a) of the GDPR), and if you consent to the processing of personal data for future recruitment purposes, we will also process it based on your consent (i.e., pursuant to Article 6(1)(a) of the GDPR).

Period of personal data processing

Your personal data will be processed in the following periods (depending on the purpose of processing):

  • for the entire period of validity of the submitted offer or – in the event of conclusion of a contract – the period during which the contract will be performed,
  • for the period necessary to fulfill specific legal obligations,
  • until the limitation period for any claims expires,
  • for the period necessary to conduct the recruitment process and select a candidate, but no longer than 6 months (in connection with the recruitment process for the position covered by the recruitment application),
  • for a period of 1 year from sending the recruitment application, if you consent to the processing of your personal data for the purposes of future recruitment for other, similar positions,
  • until the consent to the processing of personal data is withdrawn – in the case of data processed on the basis of consent,
  • until an objection is raised – in the case of personal data processed for marketing purposes on the basis of a legitimate interest,
  • until you effectively object to the processing of your personal data due to your specific situation – in the case of personal data processed for the purposes of legitimate interests other than marketing.

Recipients of personal data

The recipients of your data may be entities providing services on behalf of and for the benefit of the Agency, e.g. suppliers of external systems supporting the Agency's activities, IT or other service providers (so-called processors), external accounting office – in such a case, an agreement is concluded with these entities ensuring the security of your data.

How did we obtain your personal data?

We obtained your personal data directly from you or the source of your personal data is an Agency Client.

Is providing personal data voluntary?

Providing personal data is always voluntary, however in some cases (participation in recruitment, establishing cooperation with the Agency) failure to provide them makes it impossible to take advantage of the Agency's offer.

Automated decision making

We will not make decisions based solely on automated processing, including profiling, that would produce legal effects concerning you or significantly affect you in a similar manner.

Your rights in connection with the processing of personal data

You have the right to access your personal data, correct it, request its deletion, or object to its processing. You also have the right to request that the controller restrict the processing of your data.

Where personal data is processed based on consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

If you believe that your personal data is being processed contrary to legal requirements, you have the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
