Personal data processed in accordance with the provisions of law, including the provisions of the Regulation of the European Parliament and of the Council (EU) 2016\/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (\u201eGDPR\u201d).<\/p>\n

Purposes and grounds for processing personal data<\/h2>\n

Collaboration with the Agency<\/h3>\n

If you are a potential Client or a Client of the Agency (an individual), your personal data are processed in connection with actions aimed at concluding a contract, for example, to determine the scope of the order and prepare an offer. In the event of concluding a contract under which the Agency will provide services to you, personal data will be processed for the purpose of performing this contract.<\/p>\n

Your personal data may be processed based on and for the purpose of:<\/p>\n

  • In connection with the actions taken by the Agency before the conclusion of the contract aimed at its conclusion (determining the scope of the order for the purpose of submitting an offer) \u2013 the legal basis for processing is Article 6(1)(b) of the GDPR,<\/li>\n
  • for the proper performance of the contract concluded \u2013 the legal basis for processing is Article 6(1)(b) of the GDPR,<\/li>\n
  • to fulfill our legal obligations, e.g. those related to accounting \u2013 the legal basis for processing is Article 6(1)(c) of the GDPR,<\/li>\n
  • based on Article 6(1)(f) of the GDPR \u2013 if the processing is necessary for the purposes of the legitimate interests pursued by the controller; such a legitimate interest may be, for example, the pursuit and defense of any claims by the Agency or the marketing of its own services.<\/li>\n<\/ul>\n

    If you are a representative or employee of an Agency Client, your personal data, specifically your full name, phone number, email address, and job title, may be processed for the purpose of concluding or fulfilling an agreement with the entity that is an Agency Client.<\/p>\n

    Your personal data may then be processed on the basis of Article 6(1)(f) of the GDPR \u2013 processing is necessary for the purposes of the legitimate interests pursued by the controller. The controller's legitimate interest may be the submission of an offer by the Agency or the proper performance of a contract to which the Agency and the Client are parties, as well as the pursuit and defense of any claims.<\/p>\n

    • for marketing and statistical purposes \u2013 the legal basis for processing is the consent given by the user of our website (Article 6(1)(a) GDPR).<\/li>\n<\/ul>\n

      We process the personal data of users visiting our social media profiles (LinkedIn). We process this data only in connection with managing the profile for the purpose of informing about our activities, promoting our business, and for communication with users through available functionalities (comments, messages) \u2013 the legal basis for processing is our legitimate interest, which consists of promoting our brand and services, building and maintaining a community connected with us, and for communication purposes (Article 6(1)(f) of the GDPR).<\/p>\n

      Application form (recruitment)<\/h3>\n

      We will process the personal data provided in the application form for recruitment to positions in the Agency, including: first name, last name, contact details (e.g., email, phone number, home address), education and work experience information, as well as image (if a photo is included in the application documents). We may also process information regarding the candidate's knowledge and skills (e.g., information about language skills).<\/p>\n

      We process candidate personal data for the following purposes:<\/p>\n

        \n
      • for conducting recruitment for the position indicated in the advertisement, as part of which you send us your recruitment application,<\/li>\n
      • conducting future recruitment for various positions, if you give your separate consent.<\/li>\n<\/ul>\n

        We process candidate personal data based on various legal grounds, depending on the nature of employment for that position.<\/p>\n

        In the case of business-to-business cooperation, we process personal data based on the candidate's consent (i.e., pursuant to Article 6(1)(a) of the GDPR), and if you consent to the processing of personal data for future recruitment purposes, we will also process it based on your consent (i.e., pursuant to Article 6(1)(a) of the GDPR).<\/p>\n

        In case of employment under an employment contract, we process the candidate's personal data, including name, surname, date of birth, contact details, education, professional qualifications, and professional experience, to fulfill our legal obligation (i.e., based on Article 6(1)(c) of the GDPR). If you provide additional information about yourself in your application (e.g., image, interests), we process such data based on your consent (i.e., based on Article 6(1)(a) of the GDPR), and if you consent to the processing of personal data for future recruitment purposes, we will also process it based on your consent (i.e., based on Article 6(1)(a) of the GDPR).<\/p>\n

        Period of personal data processing<\/h2>\n

        Your personal data will be processed for the following periods (depending on the purpose of processing):<\/p>\n

        • for the entire duration of the binding offer or, if a contract is concluded, the period during which the contract will be performed,<\/li>\n
        • for the period necessary to fulfill specific legal obligations,<\/li>\n
        • until the limitation period for any claims expires,<\/li>\n
        • for the period necessary to carry out the recruitment process and select a candidate, but no longer than 6 months (in connection with the recruitment process for the position to which the recruitment application relates),<\/li>\n
        • for a period of 1 year from the submission of the recruitment application, if you agree to the processing of personal data for future recruitment for other, similar positions,<\/li>\n
        • until withdrawal of consent for personal data processing \u2013 in the case of data processed based on consent,<\/li>\n
        • until the time of objection - in the case of personal data processed for marketing purposes based on legitimate interest,<\/li>\n
        • until the effective date of your objection to the processing of personal data due to your particular situation \u2013 in the case of personal data processed for the purposes of legitimate interests other than marketing.<\/li>\n<\/ul>\n

          Recipients of personal data<\/h2>\n

          The recipients of your data may include entities providing services on behalf of and for the Agency, e.g., suppliers of external systems supporting the Agency's operations, IT service providers or providers in other areas (so-called processors), external accounting office \u2013 in such cases, an agreement is concluded with these entities ensuring the security of your data.<\/p>\n

          We obtained your personal data directly from you or the source of your personal data is an Agency Client.<\/p>\n

          Is providing personal data voluntary?<\/h2>\n

          Providing personal data is always voluntary; however, in some cases (participation in recruitment, establishing cooperation with the Agency), failure to do so will prevent you from using the Agency's services.<\/p>\n

          Automated decision making<\/h2>\n

          We will not make decisions based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.<\/p>\n

          Your rights in connection with the processing of personal data<\/h2>\n

          You have the right to access your personal data, correct it, request its deletion, or object to its processing. You also have the right to request that the controller restrict the processing of your data.<\/p>\n

          When personal data is processed based on consent, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing before its withdrawal.<\/p>\n
